§ 1 Scope and Subject Matter of the Agreement

These Terms of Use govern the use of the online platform songcontest.asia (ASC Asia), Dr. Astrid Holzmann-Koppeter (hereinafter also referred to as "songcontest.asia", "Provider" or "We / Our") by private individuals (hereinafter referred to as "Users", or addressed as "You") as well as companies (also referred to as "Users", "You" or "Companies" / "Businesses").

 

Songcontest.asia is intended as an open platform for the exchange of information about the Eurovision Song Contest Asia (ESC Asia). It is a private website with no connection whatsoever to the event or the organizers of ESC Asia. By registering or using the platform, the user confirms that they have fully read and acknowledged these Terms of Use, and that they agree with and understand them in their entirety, in the respectively applicable version. Differing terms and conditions of the user shall not apply.

Our services are provided to you for informational purposes and for private, non-commercial use only. When using our services, you must comply with these terms and conditions and all applicable laws.

§ 2 Copyright & Intellectual

Property Songcontest.asia reserves all rights to the content provided. Distribution of the content is permitted for private use, provided it portrays this platform in a positive light. The unauthorized and unlicensed use and exploitation of protected content is expressly prohibited and may have legal consequences.

§ 3 Scope of Services

Songcontest.asia provides companies with a web-based platform for the exchange of information. We reserve the right to further develop, supplement, adapt, or discontinue the functional scope of the platform. We reserve the right to exclude individuals and companies from our offering at any time without giving reasons. The offering may be discontinued at any time without giving reasons and without prior consultation. There is generally no legal entitlement. The offering of songcontest.asia may vary depending on the country. There is no (legal) entitlement to the full range of services.

The services of the online platform songcontest.asia, are free of charge until further notice. We reserve the right to make the offer on this website or part thereof subject to a fee at any time and without separate notice or giving reasons. In addition, we reserve the right to finance the platform without prior notice, including through advertising revenue. Access to the online platform may be discontinued at any time without giving reasons.

§ 4 Registration and User Account

The use of the platform requires full registration by the user. When you register for our community (songcontest.asia), you must provide personal data (e.g. name, email address etc.). All persons are required to provide truthful and complete information when registering. Each person may only register once. False or incomplete information may result in legal consequences and exclusion from our community and website.

​When you register, your name and profile will automatically be publicly displayed. You can change this in your settings. In your settings, you can also add or change other personal information and adjust additional privacy settings.

 

The user undertakes to provide only truthful and complete information and to update it immediately upon any changes. Access credentials must be kept confidential and must not be passed on to third parties. Songcontest.asia is entitled to temporarily block or permanently delete accounts if there is justified suspicion of misuse or violation of these Terms of Use. Songcontest.asia assumes no liability for the content provided and posted by companies and users.

You can create and access your member account via our website or, if applicable, via a third-party platform such as Facebook (the “social network account”) or Google. If you log in via a third-party platform account, you hereby grant us access to certain information about you that is stored in your respective account.

By registering with our community, you automatically agree to be contacted by us via email, particularly with regard to newsletters or advertising and marketing purposes.

We may permanently or temporarily block or suspend access to your member account without giving reasons and without prior notice, without any liability claims on your part. You have the right to delete your account yourself at any time or to request deletion. 

 

Alle people using the platform songcontest.asia agree to defend and hold songcontest.asia harmless from and against all actual or alleged claims, damages, costs, liabilities, and expenses (including reasonable attorney's fees) arising out of or in connection with the use of the website and services in violation of these terms. Users undertake to use the platform solely for its intended purpose and in accordance with applicable law. In particular, it is prohibited to misuse the platform or its technical infrastructure in order to cause harm to songcontest.asia, individuals, or companies. Advertising is also prohibited. Violations of these obligations entitle songcontest.asia to immediately block the account and to assert claims for damages.

Songcontest.asia strives to ensure the highest possible availability of the platform but does not guarantee uninterrupted accessibility. Scheduled maintenance work will, where possible, be carried out outside of peak usage times and announced in advance. There is no entitlement to compensation in the event of temporary outages.

§ 6 Responsibility for Your Posts

You may post text, files, images, photos, videos, sounds, musical works, copyrighted works, audio files, fonts, logos, trademarks, illustrations, compositions, applications, comments, information, and other appropriate material (collectively, “User Content”) on or through our Services.

By displaying or publishing (“posting”) user content in or through the services provided by us, you hereby grant us a non-exclusive, fully paid and royalty-free, worldwide, limited license to use, modify, delete, supplement, publicly perform, publicly display, and reproduce such user content as part of the services by distributing part or all of the services in the appropriate media formats via the media channels we support.

You represent and warrant that: (i) the User Content you upload or make available through the Services is owned by you or you otherwise have the right to grant the license described in this section; (ii) the posting and use of your User Content in or through the Services does not violate any privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or other rights of any person, and (iii) the posting of your User Content in the Services does not violate any agreements between you and any third party.

Unless expressly permitted by these Terms, you may not: (i) use our Services in any unlawful or fraudulent manner (including infringing the rights of third parties) or for the purpose of collecting personal data or impersonating other users; (ii) alter or use our copyright, trademark, or other proprietary rights notices, or interfere with the security-related features of our Services; (iii) use our services in any way to manipulate or falsify content or undermine the integrity and accuracy of content, or take any action to disrupt, damage, or interrupt any part of our services; (iv) use our services to send, receive, upload/post, or download material that does not comply with our content standards; (v) use our services to transmit or facilitate the transmission of unsolicited or unauthorized advertising or promotional material; (vi) use our services to transmit or upload data to our services that contains viruses, Trojan horses, worms, time bombs, keystroke logging, spyware, adware, or other malicious programs or similar computer code designed to adversely affect the operation of computer software or hardware; (vii) use robots, spiders, other automatic devices, or manual processes to monitor or copy our website or other websites or the content contained in our services, or use network monitoring software to determine the architecture of our services or extract usage data from our services; (viii) engage in any conduct that restricts or inhibits any other user from using and enjoying our Services; or (ix) use our Services for any commercial purpose or in connection with any commercial activity without our prior written consent. You agree to cooperate fully with us in investigating any activity that is suspected of or actually violates these Terms and Conditions.

Posts that violate these Terms of Use will be removed without prior notice. Songcontest.asia reserves the right not to publish posts without giving reasons, or to delete already published posts. You bear sole responsibility for the content of your posts. In the case of demonstrably false statements of fact or unlawful content, you shall be liable to the affected party as well as to songcontest.asia in accordance with the applicable statutory provisions.

 

Songcontest.asia reserves the right, upon receipt of appropriate notifications, to forward the relevant user data to the competent authorities to the extent permitted by law. You agree to defend and hold songcontest.asia harmless from and against all actual or alleged claims, damages, costs, liabilities, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the website and services in violation of these terms.

§ 7 Links / Redirects Songcontest.asia may refer to external sites via links. Songcontest.asia assumes no responsibility for the content and security of these websites and is not liable in the event of irregularities, violations, or any damages.

§ 8 Limitation of Liability Songcontest.asia is generally not liable for any damages or defects. Liability for indirect damages, loss of profit, and loss of data is definitively excluded. Songcontest.asia is not liable for damages caused by the abusive use of the platform by third parties.

§ 9 Data Processing

You automatically consent to all your information being processed within the framework of this website / platform and, in the event of a change of operator or owner, being transferred to the new operator. In the event of a complete or partial sale, transfer, or other restructuring (e.g. through the sale of the domain or the website project / platform) of songcontest.asia, user accounts and associated personal and company-related data may automatically be transferred to or made accessible for the new operator without requiring any further consent.

§ 11 Amendments to These Terms of Use

Songcontest.asia reserves the right to amend these Terms of Use at any time. The current version is available at songcontest.asia/nutzungsbedingungen. Continued use of the platform after amended terms come into force shall be deemed as consent.

§ 12 Applicable Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising out of or in connection with this agreement is Villach, Austria.
